Oil & Petroleum Product Spills
I have experience in environmental law cases involving oil spills, leaking tanks and petroleum accidents. From August of 2000 to November of 2005, I worked as an Assistant Attorney General for the State of New York in the prosecution of oil spill cases under New York's Navigation Law (the Oil Spill Law).
Under the Oil Spill Law, if you discharge or own property upon which there occurred a discharge of more than 2 gallons of petroleum, you are strictly liable for the cleanup and restoration of the property. I have handled cases involving underground tanks that leak and those where someone overfills a gas tank. The law can be complicated for those facing a petroleum leak where local, state and federal laws may come into play. I worked as trial counsel and was responsible for the prosecution of civil cases dealing with the recovery of funds expended in the investigation, containment and remediation of petroleum product contamination by individual and corporate Responsible Party (RP) defendants under New York's Navigation Law.
My responsibilities included coordination with enforcement agencies and personnel, including law enforcement, the investigation, trial preparation and coordination of evidence-gathering, and working closely with engineering staffs at the New York State Department of Environmental Conservation (NYSDEC), Counsel and Executive Director of the Oil Spill Compensation Fund of the New York State Comptroller's office.
